Court: Ex-chief was wrong

KENTUCKY - The Kentucky Court of Appeals upheld a judge's decision last year to hold then-state Corrections Commissioner John Rees in contempt of court for refusing to release an inmate despite the judge's order. The state Justice and Public Safety Cabinet had asked the Court of Appeals to overturn the contempt charge and $500 fine, claiming Jefferson Circuit Judge Judith McDonald-Burkman didn't have the authority to release the inmate, Daniel Ottman, on shock probation.

At issue is whether state law allows a juvenile convicted of a violent crime to receive shock probation, which would mean the juvenile could be released after serving 30 to 180 days. Read more.
